Trump’s March executive order directed the Department of Homeland Security and Social Security Administration to build verified citizen eligibility lists. It further instructed the Postal Service to accept and deliver federal mail-in and absentee ballots only when states supply participation lists of the exact voters receiving them—and only when those ballots carry trackable, unique Intelligent Mail barcodes on the envelopes. The goal is simple: no more anonymous floods of ballots with no verified chain of custody. If a state wants the U.S. mail system to move its ballots, it must play by transparent rules.
More than 20 mostly blue states and the District of Columbia sued, claiming the requirements would disrupt their November midterm planning and somehow “disenfranchise” voters. Talwani bought the argument and issued the injunction in June. The Supreme Court’s conservative majority rejected that, holding the states lacked standing because any claimed harm was speculative. The unsigned order made clear the executive order itself does not injure the states, so a district judge had no business freezing the entire effort. Liberals on the Court dissented, as expected.
This is not abstract. Democrat strongholds have long relied on expansive, loosely tracked mail voting. Late-arriving ballots, universal mail programs, and minimal verification have been defended as “access” while critics correctly note the openings for ballot harvesting, incomplete rolls, and unverifiable votes. Trump’s order does not ban mail ballots. It demands the same accountability any private package already receives: a list of who is getting the item and a unique tracking identifier. States that scream about “democracy” while refusing to disclose who receives government-issued ballots reveal their priorities.

Other litigation remains, including a separate nationwide block on certain USPS enforcement steps, so full rollout before the midterms is not guaranteed. But the Supreme Court has now removed the primary injunction that covered the 23-state coalition. The administration can move forward while further challenges play out.

Monday’s decision is a win for those who still believe elections should be secure, verifiable, and finished when the polls close—not weeks later with envelopes of unknown origin.
