Assistant Attorney General Harmeet Dhillon just dropped a clear warning that should have been standard operating procedure years ago. In a message blasted to top election officials in all 50 states, the head of the DOJ’s Civil Rights Division declared: “It is a CRIME to knowingly allow noncitizens to vote in federal elections.” She added that the division has notified every state of these long-standing federal statutes and “we will enforce them.” Federal criminal laws that previous administrations treated as optional are finally being treated as real.
Dhillon’s team is not hiding the ball. The Voting Section under her leadership has rewritten its mission around free, fair, and honest elections unmarred by fraud, error, or suspicion. That means cleaning voter rolls, blocking illegal votes, and treating citizenship as a non-negotiable requirement for federal ballots. Letters have gone out warning state and local officials that knowingly retaining noncitizens on the rolls or facilitating their ballots can expose them to criminal liability for aiding and abetting. Some states have homework to do. The ones that cooperate are finding problems: hundreds of thousands of dead people still listed and tens of thousands of names lacking citizenship records in the states reviewed so far.
This is a sharp break from the prior culture at the Civil Rights Division, which spent years more focused on suing states over voter ID and other common-sense safeguards than on protecting the integrity of the citizen vote. Dhillon has been explicit: people are policy. The old attitude that isolated illegal votes or noncitizen registrations weren’t worth pursuing unless they flipped an entire election is gone. She has described a “broken windows” approach — investigate every credible lead and prosecute every case the evidence supports. Activists, local officials, and data matches are generating tips. The department is running them down.

Are there prosecutions, or is this still just talk?
There have been prosecutions for election fraud and illegal voting in past cycles. The Heritage Foundation’s database catalogs well over 1,600 proven instances across decades — false registrations, double voting, absentee ballot schemes, ineligible voters (including noncitizens and felons), vote buying, and more. Individual cases produced convictions in multiple states. Local schemes, like ballot stuffing in Philadelphia wards involving a former congressman and election judges, resulted in guilty pleas. Noncitizen voting cases existed but were sparse and rarely prioritized at the federal level.
Under the current administration the pace has increased. Dozens of noncitizen voting cases have moved forward with arrests, charges, pleas, and convictions in places like Florida, New Jersey, Massachusetts, Pennsylvania, and elsewhere. Investigations into roughly 90 more were reported earlier this year. ICE and Homeland Security Investigations have assisted on identity-theft and long-running illegal voting schemes. Some defendants face prison time and deportation. Dhillon has pointed to these as proof the department is no longer looking the other way.
What remains thin is high-level accountability for officials or organizations that systematically enabled or ignored the problem in prior elections. Warnings and civil pressure on voter-roll maintenance are new and necessary. Criminal cases against the people who knowingly kept dirty rolls, pushed motor-voter registration without citizenship checks, or looked away from obvious red flags have not yet matched the rhetoric. Replies under Dhillon’s announcement reflect the skepticism: telling states the law exists is one thing; locking up the facilitators when they violate it is another. That gap is real.

Dhillon’s Civil Rights Division is primarily civil, not the criminal Public Integrity Section that traditionally handled election crimes. Coordination across the department and with U.S. Attorneys is required for actual indictments of officials. Some blue-state secretaries of state have already signaled they will resist or ignore the notices. Michigan’s Jocelyn Benson is a frequent example cited by frustrated voters. Enforcement will require more than letters.
The stakes are straightforward. Every illegal vote cancels a legal one. Close races decide control of Congress and statehouses. Motor-voter systems, expansive mail ballots, and weak list maintenance created openings that previous DOJs treated as political inconveniences rather than legal problems. Dhillon is reversing that. The SAVE America Act (or similar proof-of-citizenship requirements) would lock in the principle permanently instead of relying on case-by-case enforcement.
Talk is useful when it changes incentives. Prosecution is what changes behavior. The notices have gone out. The data reviews are underway. Election monitors are being deployed. The test for 2026 and beyond is whether the department follows through with real cases against those who knowingly enable illegal voting — not just the individual noncitizen who fills out a form, but the officials and systems that made it easy. Anything less leaves the same vulnerabilities in place and the same justified distrust among citizens who expect their vote to count equally.
Americans deserve elections where only citizens vote and every legal ballot is protected. Dhillon is saying the quiet part out loud and putting the machinery in motion. Now deliver the prosecutions that prove it isn’t performance.
