Newly circulated messages attributed to the woman behind the Cornell 7 allegations appear to show her describing the encounter as a “gangbang” and writing that nobody should feel shame because it was “our body, our choice.” Critics say the texts were kept out of the wider media narrative and argue they raise major questions about how this case has been presented.
But the timeline matters. Her account reportedly changed after she later saw messages in a fraternity Snapchat thread and reconsidered what happened. The accused men deny criminal wrongdoing, the investigation has been reopened and no charges have been filed. These messages could become important evidence, but on their own they do not prove that a knowingly false report was made.
Cornell 7: She Called It a Gangbang. Said It Was Legal. The Press Cut That Line.
Two days after the night at Cornell’s Chi Phi house, the woman now known as Jane Doe texted one of the seven men she later accused of rape. She told him none of the sex was illegal. She called it a gangbang. She wrote “our body our choice.” She said she liked being with him and another brother, and that she loved them. National outlets that rushed the rape story buried those lines. New York Democrats then yanked the case from the local prosecutor and handed it to Letitia James, who had already called the accuser a survivor.
The night was October 19 into October 20, 2024, at the Chi Phi house in Ithaca. Jane Doe was 20. She went to meet a friend, Matthew Ingalls. Alcohol, marijuana, and ketamine were in the mix. A Snapchat group called “Chi Phi Actives” later became the press’s favorite exhibit. The civil complaint says one message read “free pussy” upstairs, and another asked if the “shop” was still open. Crude texts from drunk frat guys are not the same thing as a criminal conviction. No one has been charged.

On November 8, 2024, she reported it to campus police. Tompkins County District Attorney Matthew Van Houten reviewed a six-page sworn statement she signed that month. He has been blunt about what was in it. Her statement did not say she was drugged against her will. It did not say she was gang-raped. It described the drugs and the sex as “voluntary, conscious, and consensual.” He also said that each time she asked to stop, the sex stopped. Under New York law, that is not a rape case a prosecutor can take to a jury. His office declined charges. A CBS snippet later quoted her telling police, “I can say with 100% confidence I was raped.” Van Houten says his office never saw that transcript.
Cornell ran its own Title IX case. That is the campus sex-misconduct process, not a criminal court. A hearing panel expelled Ingalls and Jonathan Newell. It suspended Winston Lee and Gillio Lopes. Diego Sarabia, who had already graduated, was barred from campus for three years. Scott Norris and Scott Kretzschmar got no-contact orders, training modules, and reflection papers. The Chi Phi chapter was shut and is still banned. Her lawsuit later claimed the men mostly had to write essays. Cornell says that is not what happened. The Daily Sun, working off university records, printed the heavier sanctions.

Then September 2026 hit. She filed a 101-page civil suit in New York County Supreme Court. A civil suit is a money case, not a criminal trial. She sued the seven men, Cornell, the fraternity, her sorority, and a local bar. The complaint says she was drugged and assaulted while she could not consent. The seven named are Matthew Ingalls, Jonathan Newell, Winston Lee, Gillio Lopes, Diego Sarabia, Scott Norris, and Scott Kretzschmar. All of them have denied criminal wrongdoing through lawyers or in the campus hearings. One lawyer called the allegations “selfishly false.”
The lawsuit went national in days. Student media named the men. Social media did the rest. Jobs were reportedly lost. On September 28, Van Houten said he would reopen the file and take it toward a grand jury, the citizen panel that decides whether criminal charges can be filed. He said new material and public pressure were the reason.

Three days before that reopening talk turned into a political handover, Attorney General Letitia James posted that what this young woman endured was “horrific and unacceptable,” and told “survivors” they were not alone. On October 1, Governor Kathy Hochul signed an order making James the special prosecutor. That means the governor pulled the case from the elected county DA and gave it to the state AG, who can investigate and, if she wants, send it to a grand jury. James had already picked a side in public.
Lopes sued on October 7 to knock James off the case. His lawyer, Andrew Miltenberg, wrote that she had shown “a bias and a presumption of guilt.” A judge set arguments for October 29 in Monticello. On Friday, Winston Lee joined him. Lee’s lawyer, Teny Geragos, called the Hochul-James move a public political stunt a month before Election Day, and said they had already prejudged guilt.
Then the texts landed.

But a better observation would examine the history of presidential misconduct, the influence of rap music on cultural attitudes toward women, and the feminist movement’s own role in shaping the very culture it now decries.

TMZ published the October 21, 2024 thread between Doe and Newell, two days after the party. Newell apologized, said his memory was fuzzy, and said he and “Matt” felt awful for being too messed up to shut it down. She wrote back that her memory was clouded too, and that they were all way too drunk and high. Then the lines the clip is built on:
“at the end of the day non of the sexual stuff was illegal and honestly i really liked being w u and matt. so anything anyone has to say about the gamgbang is out of their jurisdiction. i don’t think we should feel any shame for the part. our body our choice asf.”
She also wrote that she loved him and Matt, and that she would not go quiet on them. She talked about other guys who should have left the room. In one message she referenced doing ketamine off him.
On November 3 the tone flipped. She texted Newell that 90 percent of the night was not consensual, that she was given more ketamine than she could remember, and that she had said she was uncomfortable. She reported it to campus police five days later. Her lawyer, Thomas Giuffra, told the New York Post she was in denial, then shame, then acceptance, and that her memory changed after she saw the frat chat and a later brag about an “eightsome.” That is the defense. Readers can weigh it against a text she sent while the night was still fresh, in which she called the sex legal and told the men not to feel shame.
Rep. Nancy Mace put the plain version on X Thursday night: “IDK who needs to hear this, but a consensual gangbang is not a rape.” The post blew past a million views. Legacy outlets treated her like the scandal. The Federalist checked the coverage of the same thread and found The New York Times and CBS New York left out “gangbang” and “our body our choice.” They kept the softer lines and dropped the ones that cut against the rape frame.

The online pile-on already hit the wrong house. On Friday, Judge Phaedra F. Perry-Bond sealed filings in the civil case on her own, writing that “vigilantes” had used a bad address to flood a former Marine and his family with threats because he shares a name with one of the defendants. Open courts are the point. Doxxing a stranger’s family is not accountability.
Cornell’s board, for its part, hired Sally Yates and King & Spalding on October 6 to review how the school handled the case. That is a cleanup crew, not a verdict.
Where it stands tonight: nobody has been criminally charged. The civil suit is pending. James is still the special prosecutor unless a judge removes her on October 29. The texts do not, by themselves, prove a knowingly false police report. They do show her own words, two days later, calling the sex legal, calling it a gangbang, and telling two of the men she loved them. The press led with the frat chat and the lawsuit. It got quiet when her phone log showed up.
Lawyers for the accused are already in court over James. If those texts hold up, the next filings will not all be hers.
