CHAOS: Lula Declared Winner After Supreme Court Extends Voting. NY Times Says Annulment Is on the Table. Flávio Bolsonaro Needs to Leave Brazil Now.

Brazil’s October 25, 2026 presidential runoff ended in confusion and open challenge. Luiz Inácio Lula da Silva was declared the winner. Flávio Bolsonaro refuses to concede. The New York Times notes that lawyers see a serious case for challenge over a last-minute Supreme Court order that extended voting after many stations had already closed.

The Election

• First round: Flávio Bolsonaro (Liberal Party) led Lula by more than 2 million votes. Polls and analysts treated him as the favorite going into the runoff.
• Official runoff result: Lula (Workers’ Party) 51.8% (about 64.3 million votes) to Flávio’s 48.2% (about 59.8 million). Margin roughly 4.4 million votes.
• Between rounds Lula added about 10.4 million votes. Flávio added about 3.7 million. Lula took the large majority of the new and previously undecided ballots.
• This was the first time since direct elections returned in 1989 that the second-place finisher in the first round won the runoff.

The Supreme Court Move

• Polls were scheduled to close at 5 p.m. nationwide.
• At approximately 5:03 p.m., Supreme Federal Court Justice Cristiano Zanin—Lula’s former lawyer and a Lula appointee—ordered voting extended two hours to 7 p.m. across the country.
• The order came after many stations had already closed and powered down their machines. Closed machines could not simply be reopened. Some areas kept accepting votes; others were finished.
• Both campaigns had asked for extra time in places (Lula’s side cited bus and transport shortfalls in some cities; Flávio’s side cited rain in parts of the south). Zanin’s nationwide order still created unequal conditions once stations had already shut.
• Flávio Bolsonaro called the decision unprecedented, said the rules were changed mid-game, and announced he would seek annulment. He stated it was “impossible to recognize the election results, given the circumstances.”

What the New York Times Reports

The Times described Lula’s comeback as remarkable and unexpected by most pollsters. On the legal side, it reported lawyers treating the extension as a serious problem.

• Electoral lawyer Priscilla Sodré Pereira: “This is an extremely serious, critical situation.”
• Fernando Neisser, electoral law professor at Fundação Getulio Vargas: the election could be annulled if the margin is very narrow and it is shown that polling stations stayed open longer in areas that strongly favor one candidate.
• Other options noted include a technical audit of unequal conditions and an abuse-of-power case that could still challenge the Lula-Alckmin ticket even after inauguration.
• One professor told the Times many stations had already closed when the order became public and there was no significant influx of voters after 5 p.m. The 4.4 million-vote margin is larger than Lula’s 2022 margin, which makes a full annulment harder. Most Brazilian analysts quoted elsewhere say the chance of overturning the result is low. The process itself was broken by the timing and the unequal reopenings.

Flávio Needs to Leave Brazil Now

Jair Bolsonaro is already under house arrest after a 27-year sentence tied to the post-2022 events. The same court network that just extended voting is the one that has pursued the family and allies. A left-wing deputy has already moved to seize Flávio’s passport and treat him as a flight risk for contesting the result.

Flávio and the family should get out while they still can. The voters gave the right a first-round lead and a strong runoff showing. The court delivered the outcome.
