Secretary of State Marco Rubio announced Friday the US is barring all transactions with the International Criminal Court and told America’s allies he expects their help in reining in the “rogue” body.
Rubio declared in a statement the US was moving to cripple the court’s economic reach for threatening to bring cases against American troops, border agents and politicians.
“For decades now, both Republicans and Democrats have rejected the idea that the International Criminal Court has any power to prosecute American citizens, to prosecute military servicemembers, or political leaders because America never joined the court,” Rubio said in a video posted on X.
‘We Don’t Want It’: Rubio Sanctions ‘Rogue’ ICC to Shield Americans From Foreign Prosecutors
Secretary of State Marco Rubio posted a clear video on X today. In it, he announced that the Trump administration is sanctioning the International Criminal Court itself.
“We don’t need that court and we don’t want it,” Rubio said. “Either the ICC will end its threats, or we will end the ICC.”
The move bans U.S. transactions with the court in The Hague, freezes any assets it holds under American jurisdiction, and cuts off the money and services it relies on. Rubio called the ICC a “rogue court” and a “fake ICC” run by “globalist experts an ocean away” who want more power at America’s expense. He said they have threatened cases against U.S. troops, Border Patrol agents, and elected leaders.

The International Criminal Court started in 2002. Countries that signed its founding treaty, the Rome Statute, agreed it could try genocide, war crimes, and crimes against humanity when their own courts would not. The United States never joined. President Bill Clinton signed the treaty at the end of his term, but the Senate never ratified it. President George W. Bush later told the UN the U.S. did not intend to become a party. Congress passed the American Service-Members’ Protection Act to shield U.S. troops and officials from the court.
The ICC has still claimed it can go after Americans and Israelis for actions on the soil of member countries. It investigated alleged actions by U.S. forces and CIA officers in Afghanistan. It also issued arrest warrants in November 2024 for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant over the Gaza war. The United States and Israel reject the court’s authority. Neither country is a member.

President Trump has opposed the court for years. In his first term, his administration sanctioned the ICC prosecutor over the Afghanistan probe. Those sanctions were later lifted under Biden. When Trump returned to office, he signed an executive order in February 2025 declaring the ICC’s actions against Americans and Israelis a national emergency. The administration then sanctioned individual judges and officials. Today’s step targets the court as an institution.
Rubio said both parties have long rejected the idea that the ICC can prosecute Americans. Only President Trump has the resolve to stop it. The sanctions give the court’s member countries 180 days to negotiate a fix before full restrictions hit. Rubio told allies that rely on American troops for their defense to rein the court in. If they do not, he said, the United States will continue dismantling it “brick by brick, until Americans are threatened no longer.”
Netanyahu welcomed the sanctions, calling the ICC a political body that threatens law-abiding democracies and national sovereignty. The court itself called the measures an assault on the rule of law. Rubio’s message stays the same: the United States and its people are not subject to the jurisdiction of this court.
For decades, American leaders of both parties said the ICC had no business claiming power over our citizens or military. President Trump is the one acting on that position.
