Rogue FBI Official Weeps Outside Court as Trump DOJ Charges Her for Hunter Laptop Cover-Up Lies
Former FBI Deputy Assistant Director Nikki Cole Floris broke down in tears in a Washington DC courthouse hallway Tuesday while facing charges she lied to Congress about the bureau’s role in burying the Hunter Biden laptop story. Her co-defendant, former Foreign Influence Task Force Section Chief Bradley Benavides, sat with her as the preliminary hearing unfolded.

The pair led the FBI’s Foreign Influence Task Force during the 2020 election. Prosecutors say they were deep in the Hunter Biden probes, hosted briefings, coordinated responses to the New York Post’s October 14, 2020 laptop story, and helped push the Russian disinformation line that got the emails censored. Mark Zuckerberg has already said the FBI’s “disinformation” warning is what made Facebook bury it.
In 2023 testimony to the House Judiciary Committee, Floris said she had no involvement in the Hunter Biden investigation. Benavides claimed he first learned the FBI had the laptop from Wikipedia. Internal emails, chat logs, and witness accounts say otherwise. Floris even privately said she was “basically running a shadow government.”
They self-surrendered last week after U.S. Attorney Jeanine Pirro and FBI Director Kash Patel announced the charges. Each faces one count of making false statements to Congress under 18 U.S.C. § 1001. Maximum five years if convicted.
The timeline runs from the Post story through the censorship push, the 2023 denials under oath, and the October charges.
On Tuesday, Magistrate Judge Zia Faruqui heard a full day of testimony. During a break, Floris was seen weeping in the hallway. The judge later struck down a superseding complaint the DOJ tried to file in the middle of the night adding an obstruction charge. Faruqui asked why prosecutors would “upend the entire history of how we charge cases” and said they acted as if they were afraid he would not find probable cause. He called the whole thing “a sideshow on top of a sideshow.”
The government’s own witness, FBI Special Agent Bryan Witt, testified that people in his office generally viewed the case as a “witch hunt.” He was pulled off public corruption work in Missouri, worried it looked political, and said the assignment from Patel the morning after Trump named the pair was unusual.
These are the same officials who helped shape the public narrative right before the election. The laptop was real. The emails were real. The cover-up was coordinated. Now one of them is crying outside a courtroom while the other sits under the same charges.
Accountability is slow. It is not finished. The hearing continues. The rest of the people who ran the same play are still free.
