Hinojosa’s own campaign site states the plan directly: freeze the rates residential customers pay “until we have laws to ensure that data centers and other high-load users pay for themselves.” She has also called for an extended moratorium on new data center approvals and more rules on water, power, and local input.
Texas already runs an energy-only market that depends on scarcity pricing to keep dispatchable plants online and to pay for the next one. Caps and freezes remove that pressure. After Winter Storm Uri, the legislature and ERCOT added weatherization rules, mapped critical gas sites, and tightened standards. The grid has cleared several winter and summer demand records since 2021 without statewide rolling blackouts. ERCOT’s own recent winter outlook put the chance of an energy emergency in the riskiest hour around 3 percent.

That margin is not unlimited. Data-center and large-load growth has stacked demand. Worst-case ERCOT capacity reports have flagged potential shortfalls as early as 2027 under heavy load scenarios. Hinojosa’s rate freeze does not add firm generation. It tells existing plants and future builders that the upside on the hottest or coldest days just got smaller while the political risk got larger.
Price controls have a long track record. Rent control produces housing shortages. Fuel price controls in the 1970s produced lines and rationing. When the controlled price sits below what it costs to produce and deliver the next unit during peak hours, producers cut back or stay offline. Demand keeps rising. The physical shortage shows up as rotating outages.
Hinojosa takes office in January. The 2027 legislative session will be the first under Democratic control of the House. Data-center siting, transmission cost allocation, and resource adequacy are already on the agenda. A residential rate freeze layered on top of an extended data-center pause does not solve the reliability gap. It shifts the pain.
Texans who remember Uri know what controlled load shed looks like: neighborhoods dark for hours, pipes freezing, grocery stores closed, hospitals on generators. The difference this time is that the policy trigger is known in advance. Get a generator and fuel plan. Check your critical circuits. If you have the option, start looking at on-site backup or reduced dependence on the grid.
