Democrats and their media allies are openly laying out the arrests, prosecutions, and revenge they plan once they regain power.

- Kara Swisher, on The Bulwark podcast (widely clipped on YouTube and X), said under Kamala Harris “he might be in jail right now” because of questions around Musk’s companies. If Trump loses the House and Senate, “I would worry” for him. “You think he’s not on the list? He’s at the top of that list. Donald Trump obviously is at the top, and his family.” Musk replied on X: “Live by the sword, die by the sword. Sounds like Swisher really wants to go to prison.”

- Jennifer Welch and Jim Acosta, in a widely circulated January 2026 YouTube clip from their discussion (also on X), called for mass prosecutions of Trump, Musk, and Republicans as the path to “national reconciliation.” Welch said Congress would haul Musk and others in to demand “What crimes did you commit?” and that Trump, Musk, and “bottom-feeding” allies “commit crimes every day.” Acosta added that expanding the Supreme Court would be needed so Trump could be jailed. They framed it as the only serious response once Democrats retake power.
- Sen. Elissa Slotkin has talked up “signature cases” targeting the most egregious Trump-administration actions and the people who enabled them, to deter future service. Conservative outlets have treated the comments as a clear signal of planned lawfare once Democrats control committees.
- Politico reported Democrats already mapping probes into Musk’s DOGE role, government contracts, SpaceX/Starlink decisions on Ukraine, and related conflicts of interest if they take the House or Senate after the midterms. Musk answered: “Those who pick fights with me should understand that I will find out who is really pulling the strings and come for them, not just their puppets.”
- On X, Elon has repeatedly amplified and responded to posts claiming Democrats will arrest “everyone,” restart investigations, pack the Court, admit DC and Puerto Rico as states, and flood the country with migrants to lock in permanent control. One recent Musk post listed the 2028 clean-sweep scenario as the path to a one-party state and the end of meaningful democracy.
House Democrats and aligned voices have also previewed broad probes into Trump family finances, pardons, DOJ handling of cases, and related issues, with criminal referrals as an option. The pattern is the same one used in the first Trump term: investigations, referrals, and criminal cases timed for political impact.
They are telling voters the plan on X, YouTube, and podcasts. Musk is treating the threats as real and answering in kind. The midterms and 2028 will decide whether those plans move from talking points to subpoenas and indictments.
