THEY LOST THE GATE. NOW THEY WANT A JUDGE.
President Trump told three shops Friday they were done walking the West Wing like they owned the lease. CNN, MS NOW — the old MSNBC under a new paint job — and Politico got the word on Truth Social. Saturday morning the Secret Service made it real. Badges dead. Gates closed. Camera positions gone.
Monday they lawyered up.
The three outlets notified the government they are filing in D.C. federal court and asking a judge for an emergency order to put them back inside. They hired Ted Boutrous, the First Amendment specialist who got CNN’s Jim Acosta’s hard pass restored in 2018. The complaint names Trump, Chief of Staff Susie Wiles, Communications Director Steven Cheung, and Secret Service Director Sean Curran.
Their joint line: “Without notice or process, the White House revoked our journalists’ credentials because it objected to our reporting.” They called the ban “a more direct assault on the First Amendment” than anything that came before it.
Trump’s line is shorter. They write fiction. They write lies. They do it on purpose. He does not have to hand them a desk in the People’s House while they do it. The American people are behind President Trump. We are all tired of the Deep State trash thrown at him. The lies are just beyond imagination – which means Trump stopping their access is a good thing by anyone’s logic.
The 72 hours
Friday, Sept. 18, Trump posted that he was “proud to announce” an immediate ban on “Fake News CNN,” “MSNOW,” and Politico “as a result of their constant ‘reporting’ FAKE NEWS.” He said media outlets “shouldn’t be able to constantly write or report FICTION and LIES when they’re covering the President of the United States, the Trump Administration, or the United States of America.” Then the kicker: “Other Fake News Media Outlets to follow.”
He named Politico as the shop that took what he called an “illegal and ridiculous $8 Million Dollar subscription” from the Biden government “in order to keep them ‘alive.’” He said MS NOW changed the letters because the old brand was out of viewers and out of credibility.
In the Oval Office the same day he did not pick one story. He called it cumulative. “There’s something wrong with a country that can allow people to write purposely negative stories,” he said. “Now, if they want to write them, that’s fine, but I don’t have to let them into my — into the people’s house.” Asked about a court fight, he said a court should not bless fake news “day after day after day.”
Saturday the West Wing checkpoints enforced it. CNN’s Betsy Klein, MS NOW’s Akayla Gardner, and Politico’s Cheyenne Haslett were turned away. An agent told Gardner her pass had been deactivated. Camera gear and driveway positions for CNN and MS NOW went dark.
Monday CNN was pulled from its turn in the television pool — the rotating crew from ABC, CBS, CNN, NBC, and Fox that feeds video to everybody else. Fox News Washington bureau chief Bryan Boughton, who chairs that pool, told subscribers there would be “no replacement pool put in place.” The other networks declined to fill the hole. The club sat down together.

The club protects the club
Jacqui Heinrich is Fox’s senior White House correspondent and president of the White House Correspondents’ Association. She put the WHCA on the record “in defense of our colleagues at CNN, MS NOW, and Politico who are being singled out for doing their jobs.” She said First Amendment protections “do not depend on whether the president likes a news organization’s coverage.” She repeated it on Fox News Sunday.
That is the press corps talking to the press corps. A West Wing pass has become, in their telling, a birthright. Lose the pass and the country is supposed to treat it like a raid on the Bill of Rights.
Trump answered that Monday on Truth Social. “The White House is not instituting an assault on the Free Press, something which I cherish,” he wrote. “It is instituting an assault on the FAKE NEWS, something that has grown like Cancer in our beloved United States of America.”
They can still report. They still have cameras, websites, and prime-time chairs. They lost the courtesy of a badge and a folding chair ten feet from the podium. They filed a lawsuit over the chair.

Five networks rotate the feed. When CNN lost its turn, nobody moved.
America already rendered a verdict
Gallup has asked the same question since the 1970s: how much trust do you have in newspapers, television, and radio to report the news fully, accurately, and fairly. In the mid-1970s, 68 to 72 percent of Americans said a great deal or a fair amount. By 1997 it was 53 percent. It last sat above 50 percent in the early 2000s. In September 2025 it hit a new floor: 28 percent. The American people are fed up with fake news.
Seven in ten adults now say they have not very much confidence or none at all. Republicans are at 8 percent — the first single-digit reading Gallup has ever posted for that group. Independents sit at 27 percent. Even Democrats, the last constituency that still treats these shops as church, fell to 51 percent, matching their 2016 low and far off the 76 percent they posted in 2018.
That collapse did not happen because a president locked three badges. It happened because the product went bad. Russia-collusion theater. Hunter’s laptop “disinformation.” Border-is-secure segments. COVID sermons. Polls that missed by a mile and then explained the miss as your fault. Viewers walked. Ratings followed. Trust followed the ratings out the door.
MS NOW is the exhibit. The network spent a generation as MSNBC, then split from NBCUniversal into Versant and slapped a new name on the same lineup in 2025. Trump said the quiet part: they changed the letters because the old ones were toast. They have supported racism, Marxism, and a detest for all Americans, as well as President Trump.

What the last two fights actually decided
The outlets want this case to look like 2018. After a blow-up press conference, the first Trump White House pulled CNN correspondent Jim Acosta’s hard pass. Judge Timothy Kelly, a Trump appointee, ordered it back within days on due-process grounds. One reporter. One credential. Notice and a chance to answer.
The 2025 Associated Press fight was narrower still. The AP refused to say “Gulf of America.” The administration kept the wire out of the Oval and off Air Force One. A district judge tried to restore everything. An appeals court then let the White House keep the AP out of small, restricted rooms while blocking a ban from spaces generally open to the press, like the briefing room.
This one is bigger on paper — three outlets, the whole complex, the pool slot — and the other side is counting on a D.C. judge to treat a White House hard pass like a public utility. The Constitution protects the right to publish. It does not guarantee CNN a driveway riser.
Boutrous will argue viewpoint discrimination and a Fifth Amendment process claim. The White House will argue the obvious: the building is a workplace, access to restricted grounds is a privilege, and a president is allowed to stop handing the keys to shops he says are in the fiction business. Legal analysts on the other side already have their quote ready. They always do.
The problem is the product
Legacy media spent a decade telling half the country it was crazy, then acted stunned when that half stopped paying the subscription. They coordinated language. They buried stories. They laundered anonymous sources. They called it journalism and demanded a seat at the Resolute Desk as proof.
When Trump bars the shops he says lie about him, they do not audit the copy. They sue. When the networks lose a pool turn, they shut the pool instead of sending another crew. When a Republican president says the People’s House is not a soundstage for a hostile cast, the correspondents’ association files the press release.
The public already left. Gallup’s 28 percent is the receipt. Eight percent among Republicans is the evacuation. The lawsuit is what a dying industry does when it still has lawyers and no longer has an audience.
Trump said other outlets can follow. He floated the New York Times and the Washington Post in the Oval as examples of the same disease. He also said he would “love it” if they straightened themselves out. That offer is still on the table. The gate is not.
They can cover him from the sidewalk. They can file 3,000-word pieces about democracy in peril. What they cannot do, as of Saturday morning, is treat a White House badge like a birthright while they run the same operation that drove American trust in mass media off a cliff.
The judge will get the briefs this week. The country already got the product. That is why the lock is on the gate. We have freedom of the press, but that does not mean that Trump has to grant access to the White House to every fake news outlet out there. It is time we recognize certain outlets for what they are and stop supporting them in any way.
