Homeland Security Secretary Markwayne Mullin, on camera, saying what New York Democrats have spent a year trying to drown in process language: Governor Kathy Hochul’s government has been letting violent illegal aliens walk out of New York jails so ICE cannot take them. Murderers. Child predators. Rapists. Drug traffickers. Gang members. “She released them on the streets,” Mullin said. Then ICE has to hunt the same people through neighborhoods after they have already been handed a head start.
That is not a border story. That is a sanctuary story. And until someone in this administration treats the release as the offense — not just the mop-up — it will keep looking like theater.

The numbers are not a rumor
DHS put the cumulative figure on paper September 1, 2026, when it announced Operation Rotten Apple: 13,621 criminal illegal aliens released from New York custody back onto the streets instead of being transferred to ICE. Over 33 days, July 27 to August 29, ICE still managed to arrest 2,197 illegal aliens across the state — murderers, rapists, pedophiles, kidnappers, drug traffickers, violent assailants — with no help from Hochul or New York City’s socialist Mayor Zohran Mamdani. Mullin’s line was blunt: seven of the safest cities in America cooperate with ICE. New York’s Democrats chose the opposite.
This did not appear overnight. By December 1, 2025, DHS had already tallied 6,947 criminal illegal aliens released after New York refused ICE detainers since January 20, 2025. The crime list on that cohort alone: 29 homicides, 2,509 assaults, 199 burglaries, 305 robberies, 392 dangerous drug offenses, 300 weapons offenses, and 207 sexual predatory offenses. Thousands more still sat in local custody with live detainers. The machine kept running. The 13,621 number is what that machine produced by late summer.
Hochul’s office will say she did not personally swing open one prison door for 13,000 men in a single night. Fine. She signed the law that made the pipeline official. In May 2026 she enacted the so-called Local Cops, Local Crimes Act as part of the state budget — a package sold as “protecting New Yorkers against ICE.” It voids 287(g) agreements that let sheriffs work with federal immigration officers. It bars local cops from using their own resources to help civil immigration enforcement. On August 25, 2026, those agreements became “void and unenforceable.” Hochul celebrated it on camera: “I just banned it.” Fifteen county sheriffs sued. DHS answered the only way left: more federal agents on the street, because local partners had been legislated out of the building.
Mamdani added his own shield. After Hochul’s bill, the mayor’s executive order turned the city into a wall between ICE and the people already in city custody. DHS’s own release on Rotten Apple said those policies produced the 13,621 dump. That is not “due process.” That is a political decision to prefer the alien over the American standing on the sidewalk.

The theater America is tired of
Republicans talk “surge.” Border Czar Tom Homan promised to flood New York with agents if Albany cut the 287(g) lifeline. Mullin then ran Rotten Apple and held a press conference. Fox ran the mugshots. X filled up with the same loop: look what ICE caught after Democrats let them go.
That loop is real work by ICE officers. It is also the wrong sequence.
You do not “make America safe” by applauding a raid that recovers 2,100 people after a sanctuary regime released 13,000. The raid is the expensive, dangerous, second-best option. The first-best option is the jail door. ICE detainer. Transfer. Removal. Done. No grandmother’s block. No 16-year-old walking home in Huntington. No second victim so a Democrat can say she “stood up to Trump.”
DHS even begged New York not to cut one of them loose — an El Salvador national charged with raping a 16-year-old girl after a prior final order of removal from 1998. The statement was not subtle: do not release this man. Turn him over. Sanctuary politics exists to ignore that sentence.
X is not confused about this. The replies under the Wall Street Apes post and the week of posts around it are the same question, over and over: When is Hochul in cuffs? Why is a governor allowed to launder killers onto American streets? Why is the only federal verb “surge”? That is not fringe. That is the country noticing the pattern.

So why isn’t she in a cell?
Here is the part the press conference never answers, and the part that makes the whole show look like Kabuki.
First: Democrats built a legal shield and call it federalism. Sanctuary lawyers hide behind the anti-commandeering doctrine. The Supreme Court has said Washington cannot conscript state officers to run a federal program. Detainers, in most courtrooms, are treated as requests, not handcuffs on the sheriff. 8 U.S.C. § 1373 stops states from gagging officials who want to talk to ICE about immigration status — it does not, by itself, force a jail to hold a man past his local release date. Blue-state judges have spent a decade stretching that distinction into a permission slip: we don’t have to help you catch them, therefore we can empty the tank and call it principle.
Second: the criminal statutes exist. The prosecutions do not. This is the tell. 8 U.S.C. § 1324 makes it a crime to conceal, harbor, or shield an illegal alien from detection. There is no governor exception. Heritage’s Hans von Spakovsky has said the quiet part: sovereign immunity does not protect a state official from a federal criminal case if he uses his office to hide removable aliens. The White House’s own April 2025 order on criminal aliens listed obstruction (18 U.S.C. 1501), harboring (8 U.S.C. 1324), conspiracy against the United States (18 U.S.C. 371), and conspiracy to impede federal officers (18 U.S.C. 372) as the menu. In January 2025, DOJ leadership told U.S. Attorneys to investigate state and local actors who obstruct immigration commands. That was twenty months ago. Hochul is still giving pressers. Mamdani is still issuing orders. Letitia James is still sending threatening letters to sheriffs who want to help ICE.
If those memos were operational, someone in Albany would already be answering a grand jury. They have not. What America got instead: civil lawsuits, grant threats, a sanctuary-jurisdiction list, a House bill (the Shut Down Sanctuary Policies Act) that would preempt the gag rules and give victims a private right of action — and another raid after the bodies are already on the pavement.
Third: two-tier justice is not a slogan when the defendant has a D next to the name. The same political class that spent years trying to jail a former president over process crimes now discovers exquisite constitutional sensitivity the minute the target is a Democrat governor dumping predators. A sitting state judge has been prosecuted for hiding an illegal alien in her courtroom. A governor who signs a statute designed to keep ICE off the jailhouse loading dock is treated as a “policy disagreement.” That is not law. That is caste.
Fourth: the political class is addicted to the chase. A raid photographs well. An indictment of a governor starts a “constitutional crisis” cycle the networks will run for six weeks. Midterms sit on the calendar. Lawyers inside DOJ would rather win a tidy preemption case in 2027 than risk a hung jury in the Southern District of New York in 2026. So the administration talks like Andrew Jackson and litigates like a legal seminar. ICE does the dangerous work. Hochul does cable hits. The released man does whatever he came here to do.
Fifth: Democrats need the inventory. Illegal aliens change the Census, the House map, and the Electoral College whether they vote or not. They also change the street. A party that has spent a decade calling enforcement “raids” will not voluntarily hand ICE the one moment that actually works — the moment the man is already in a cell. Sanctuary is not compassion. Sanctuary is a constituency-protection program with a body count.

Stop pretending the surge is the strategy
Operation Rotten Apple is what happens when the first line of defense is sabotaged on purpose. Mullin is right that ICE officers did the job New York politicians refused. He is also describing a failure of nerve upstream. You cannot “end sanctuary cities” by catching a fraction of the people sanctuary cities already released. You end them by making the release itself expensive.
That means detainers honored as a condition of federal money — not a suggestion. It means 287(g) restored, not banned as a campaign prop. It means the Shut Down Sanctuary Policies Act on the floor, not in a committee PDF. It means DOJ picking one clean case — a homicide or child-sex offender cut loose over a live detainer after the governor signed the gag law — and testing § 1324 the way Heritage and the White House order already said it can be tested. If the statute is real, use it. If it is a press release, stop waving it.
Hochul says New York is “not a sanctuary for criminals.” DHS’s ledger says 13,621 people with detainers walked. Americans are not obligated to honor her branding. They are obligated to notice that the people doing the releasing still have security details, and the people they released do not.
Until a Democrat official pays a personal price for opening that door, the raid is cleanup. The speech is branding. The “surge” is what you do after you already lost the jail.
