The same Obama-appointed judge Trump has called a radical left lunatic is deciding whether the public sees the probable cause behind the raid on a sitting member of Congress less than a week before the midterms.
That alone is a plot twist. Then the New York Times reported Thursday that the Obama-era FBI and DHS looked into Omar’s 2009 marriage to Ahmed Nur Said Elmi in 2016 and found “some evidence that it was fraudulent.” Prosecutors walked away because the five-year statute of limitations on marriage fraud had run. No charges. The evidence stayed buried.
Judge James Boasberg — the same federal judge Trump called a “Radical Left Lunatic” after he blocked Venezuelan deportation flights — has been assigned to oversee the fight to unseal the FBI search warrant used in the raid on Rep. Ilhan Omar’s home.
The case lands on Boasberg’s desk as two separate federal investigations into Omar are underway: one examining alleged discrepancies in her financial disclosures and another probing whether her father misstated her age on citizenship paperwork in 2000, potentially allowing her to obtain citizenship as a minor. Trump has long accused Omar of committing immigration fraud, including allegedly marrying her brother, and called for her to be “put in jail” in the weeks following the raid on her D.C. home.
U.S. Attorney Jeanine Pirro fired back at media requests to unseal the warrant, calling them “rash” and arguing the investigation is still ongoing with no charges filed. Omar’s attorneys, meanwhile, are demanding the return of seized property, alleging agents violated protections for her congressional work and blocked her from contacting lawyers during the search.

Omar has spent years calling the brother-marriage allegation a right-wing conspiracy. Asked on MS NOW this month whether there was any kernel of truth that she and Elmi were related, she answered: “Not to my knowledge.” The clip has been circulating hard on X ever since.
The current probe is broader. Agents from Homeland Security Investigations hit her DC residence on October 12 under a warrant signed by a magistrate. They seized phones, computers, notebooks, and her passport. Multiple other warrants were executed the same day. DHS Secretary Markwayne Mullin has called it a strong case and said the government expects to take it to a grand jury. Investigators are looking at whether Omar or her late father misstated her age on 2000 naturalization paperwork so she could claim citizenship as a minor, plus possible conspiracy charges and discrepancies in financial disclosures. Conspiracy carries no statute of limitations.

One hundred seventy-five House Democrats, led by Pramila Jayapal, sent a letter demanding the administration halt the probe, calling it weaponization timed to sway Omar’s re-election. Nearly 40 Democrats declined to sign, including Nancy Pelosi and Steny Hoyer. Obama himself called the whole thing appalling and accused the government of trying to dig up a nonexistent smoking gun from 20 years ago.
Omar’s lawyers have called the search vindictive and unconstitutional. She has said the agents showed up early to freak her out and that Trump is behind it. Trump has said he has nothing to do with the investigation and that it is up to the Justice Department, while still describing her as a terrible person from a non-country.
The public has been told for a decade that the brother claim was debunked. Now the Obama FBI’s own files, according to the Times, show investigators found evidence the marriage looked fraudulent and still declined to act. The current team is looking at DNA, family subpoenas, and a possible wider conspiracy. The warrant remains sealed. Boasberg is the gatekeeper. Election Day is Tuesday.
